Questionnaire Terms of Use

This document contains the rules for using the Questionnaire at fairpayuk.co.uk (the “Questionnaire”). By accessing and/or using any part of the Questionnaire you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use the Questionnaire.

Confidentiality and permitted use

The Questionnaire and any documents available in it or otherwise associated are:

  • confidential to Harcus Parker Limited trading as Fair Pay UK (the “Solicitors”). They contain the Solicitors’ work product and know-how, and are commercially sensitive;
  • privileged as between the Solicitors, their clients and potential clients; and
  • only made available for the purposes of allowing potential clients of the Solicitors to evaluate whether they wish to:
    • pursue a claim for equal pay against Wm Morrison Supermarkets Limited (“Morrisons”), Asda Stores Limited (“Asda”) and/or Sainsbury’s Supermarkets Limited (“Sainsbury’s”) on the basis that they may have received less favourable pay than appropriate comparators undertaking work of equal value; and
    • use the services of a law firm.

If you do not in good faith believe that you are eligible to make a Claim, then you must not continue with the Questionnaire.

Your confirmations

By accessing and/or using the Questionnaire, you agree and confirm that you:

  • have worked or currently work for Morrisons, Asda and/or Sainsbury’s, within the past six years, in a role that may give rise to an equal pay claim;
  • in respect of a possible Claim, you have not instructed a law firm, claims management company (“CMC”) or made one yourself. If you have done so, by completing this Questionnaire, you agree that you will cancel any other claims with any other law firm or CMC;
  • have not received any damages or compensation for the same equal pay claim against Morrisons, Asda and Sainsbury’s;
  • that you have not brought proceedings in a Court or Tribunal in relation to the same claim, or, if proceedings are ongoing, you have disclosed this to the Solicitors;
  • are domiciled in the United Kingdom;
  • are not a director, principal, or employee of a CMC;
  • do not act as a solicitor, work for a firm of solicitors, or a CMC acting (or intending to act) for other claimants or defendants in any claim similar to the Claim, nor are you a member of a legal team that has been instructed to defend the Claim, and you do not intend to pass on any information about the sign-up process to them or any other person or entity with an interest adverse to the claim; and
  • do not have any bankruptcy or insolvency proceedings directly impacting you and/or any settlement you may be awarded.
